1. Acceptance of Terms

By downloading the application (“App”), or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws in the Kingdom of Morocco.

2. Subscription and Payments

Carso offers subscription plans for premium features. By subscribing to a plan:

• You agree to pay all fees processed via Apple App Store or Google Play Store.
• Auto-Renewal: Subscriptions automatically renew unless cancelled 24 hours before the end of the period.
• Cancellation: You can manage or cancel your subscription at any time through your App Store account settings.

3. User Content and AI Analysis

When you use the “Analyze” feature:

• Consent to Process: You explicitly grant us permission to send your uploaded photos and vehicle details to our third-party AI provider, Google Gemini, for processing.
• Ownership: You retain full ownership of your original photos.
• License: You grant us and our AI partners a worldwide, royalty-free license to use, host, and process your content solely for the purpose of providing the service to you.
• AI Output: The inspection reports and valuations are generated by AI and may vary from actual market conditions. You acknowledge that these are estimates, not professional guarantees.

4. Prohibited Uses

You agree not to use the Service to:

• Upload misleading or fraudulent photos with intent to deceive for vehicle sales.
• Reverse engineer the analysis algorithms or scrape data from the App.
• Use the App in any way that violates local laws or regulations.
• Impersonate a professional mechanic or certified appraiser based solely on AI results.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. AI analysis may contain inaccuracies. We do not warrant that l-application will be error-free or that the valuations will match current market transactions exactly.

6. Limitation of Liability

To the maximum extent permitted by Moroccan law, Carso (BioValley.Ma) shall not be liable for any indirect, financial, or consequential damages resulting from your use of the App, including but not limited to, losses from vehicle purchases or sales made based on AI-generated insights.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes shall be subject to the exclusive jurisdiction of the Moroccan courts.
